Environmental Protection Agency’s Climate Deregulation and Compliance Risk: What Organizations Should Watch

The Environmental Protection Agency’s decision to withdraw its “endangerment finding” introduces new uncertainty for organizations that have relied on the EPA’s regulatory framework. In essence, the EPA removed greenhouse gas emission requirements for vehicles and opened the door to further deregulation of greenhouse gas emissions in the United States. The withdrawal of the endangerment finding represents a major deregulation of U.S. climate policy and will likely result in a patchwork of state regulations and court decisions to fill the gap left by the EPA’s withdrawal.

It follows that affected organizations now need to monitor the regulatory landscape at the state level because state regulators  will likely be the source of greenhouse gas emission requirements for vehicles.
